These Terms and Conditions ("Terms") govern the agreement between you, the client ("you" or "Client"), and My Personal Finance ("My Personal Finance," "we," "us," or "our"), a UK small business providing non-regulated financial guidance and planning services.

By booking a session or engaging our services, you agree to be bound by these Terms. You must actively agree to these Terms (e.g., by ticking an "I Agree" box during the booking process) for them to be legally binding.

2. Description of Services and Scope (Exclusions)

2.1 The Service Provided: Financial Guidance Only
My Personal Finance offers detailed financial planning services, primarily delivered through bookable sessions. We work with you to develop a financial plan and strategy based on your stated circumstances. The service aims to provide guidance and information, helping you identify potential actions you could take. We will ask questions to encourage reflection and uncover aspects of your finances you may not have previously considered.
2.2 Strict Regulatory Exclusion and Financial Advice Disclaimer
The guidance and information provided by My Personal Finance is not, and shall not be construed as, regulated financial advice.
· The service is not regulated by the Financial Conduct Authority (FCA).
· The service's purpose is information only and does not recommend specific financial products, investments, pensions, or mortgages, nor does it advise on the merits of buying, selling, or holding any financial instrument.
· Exclusion of Legal and Accounting Advice: My Personal Finance does not provide legal or accounting advice or services related to tax obligations or tax planning.
2.3 Service Delivery
Services are delivered through bookable sessions via telephone, online video call, or potentially locally with a defined surcharge.
2.4 Suitability Criteria and Exclusions
Our service is designed for general UK financial planning guidance. You confirm that you meet the following criteria. The service is not suitable for individuals who:
· Are under 18 years of age.
· Are not resident and domiciled in the UK for tax purposes.
· Are US citizens.
· Require immediate, complex regulated advice.
3. Ordering and Payment Terms
This section outlines how orders are placed and sets clear payment deadlines.
3.1 Booking Sessions and Fees
All sessions must be booked in advance via our official booking platform. You agree to pay the standard fee for the service as advertised at the time of booking.
4. Delivery or Performance Obligations
This defines what we will do and what we require from the Client to perform the service.
4.1 Client Responsibility for Data Accuracy
My Personal Finance relies entirely on the information you provide to deliver suitable guidance. You warrant that all information provided to My Personal Finance regarding your personal and financial circumstances is truthful, accurate, and complete to the best of your knowledge.
4.2 Our Right to Refuse Service
We reserve the right to refuse or terminate service delivery if the information provided is deemed incomplete, misleading, or fraudulent, or if the client's financial situation falls outside the defined scope of our non-regulated guidance (Section 2.4).
5. Returns, Cancellations, and Refunds
This section explains our policies on cancellations and compliance with consumer law.
5.1 Right to Cancel (Cooling-Off Period)
You have the right to cancel this agreement without penalty up to 24 hours before the time and date of your session.
5.2 Consequences of "No-Shows"
If you fail to attend a scheduled appointment without providing adequate notice (24 hours prior), this will be treated as a "no-show." We reserve the right to charge for the missed session or treat the session as having been provided if the full-service fee has been paid.
5.3 Failure to Book Follow-Up Meetings
Some services require a follow-up meeting (Financial MOT, Second Opinion). The follow-up meeting is included in the price paid up-front. You must book the follow-up meeting within 90 days of the initial meeting. Failure to do so may mean losing the right to the follow-up meeting, at our discretion.
6. Limitations of Liability
Limiting liability is essential to protect your interests and manage risk. We cap your exposure where allowed by law.
6.1 Exclusion of Liability for Financial Outcomes
We cannot guarantee that following our guidance will result in specific financial outcomes, gains, or goal achievement. You acknowledge and accept that your capital may be at risk when implementing actions based on the plan, and we cannot be held liable for any loss or damage that arises from your subsequent actions or decisions, especially those resulting from inaccurate data provided by you (Section 4.1).
6.2 Exclusion of Liability for Third-Party Referrals
If we refer you to regulated third-party services, such as Independent Financial Advisers (IFAs), we cannot accept any responsibility or liability for their actions, guidance, or advice.
· You must conduct your own due diligence on any third party we refer you to.
· We expressly exclude liability for any loss or damage that arises from the services provided to you by any third-party professional or regulated adviser.
6.3 Referral Fee Disclosure
My Personal Finance may receive a nominal referral fee from recommended third parties, which does not influence our decision to refer you.
6.4 General Liability Cap
Our total liability to you for any breach of contract or negligence arising under these Terms shall be limited to the total amount of fees paid by you for the specific service session or package giving rise to the claim, subject to statutory requirements (such as those preventing the exclusion of liability for death or personal injury caused by negligence).
7. Intellectual Property (IP) Rights
All IP in materials provided during the service must be protected.
All intellectual property rights (IP) in the planning software, documents, content, tools, and materials we create or provide to you remain the sole property of My Personal Finance. You are granted a limited, non-transferable license to use the Financial Plan and associated materials solely for your personal financial planning purposes.
8. Confidentiality and Data Protection
We must be clear about how we handle confidential and personal data.
8.1 Use of Data and Privacy
We collect and process your personal and financial data only to deliver our services, in line with the Data Protection Act 2018 and GDPR requirements. Full details of data handling are outlined in our separate Privacy Policy, which must be read alongside these Terms.
8.2 Monitoring and Recording
You consent to the recording of phone and online video conversations for quality control, training, ongoing monitoring, and evidential purposes in the event of a dispute.
9. Termination & Cancellation Rights
9.1 Termination by Either Party
Either party may terminate the agreement according to the cancellation policy (Section 5), or if the other party commits a material breach of these Terms, including (but not limited to) instances where the Client engages in unacceptable conduct or fails to provide accurate data.
9.2 Amendments to These Terms
We reserve the right to amend these Terms. We will notify you in writing of any significant changes. You have the right to end your relationship with us if you disagree with any amendments. Terms will be reviewed at least once a year.
10. Governing Law and Dispute Resolution
This section specifies how disputes will be handled.
10.1 Compliance with UK Law
These Terms are drafted to be fair, clear, and not misleading, and we aim to comply with all relevant UK consumer protection legislation, including the Consumer Rights Act 2015.
10.2 Complaints Procedure
